Legal Question in Personal Injury in South Carolina

My Child Injured at Someone Elses Home

My daughter is 17 and went over her friend's house (18 yrs old) and got drunk. She fell and cracked her jaw in 2 places at her friends house. Can I sue the parents for my child getting hurt at their house?

What you are referring to is called the Dramshop Act. It is a law that allows a person to sue if they are injured by someone else unreasonably furnishing them with alcohol. I have handled those cases here in Horry County so I understand what your dealing with. Do you know if the parents were home, or if they knew about the drinking or if they purchased the alcohol? What county is this?

The "friend" and/or his/her parents will have liability on several different fronts. They either served alcohol to a minor and/or they allowed it to be done.
