Legal Question in Personal Injury in South Carolina

My name is Mildred Peterson. I live in Hartsville, SC. I was coming down a main 4 lane street on my way to pick up my daughter from daycare, with my oldest son in the car. A man started to pull over into my lane on my blind side and I blew my horm to keep him from hitting me. He imediately pulled back into the other lane and then hit the other person. In order for me to keep from hitting him, I slammed on my brakes. Because of having to slam on my brakes so hard and suddenly, it caused me to now have back and neck pains. The accident scared my son so bad that he is now having chest pains that maybe anxiety attacks that is coming from the excitement of what took place. My son has a medical condition with chronic asthema that if excited, will cause panic attacks. I do know the person that caused the accident and will be able to contact him if I need to. I can't tell if you have a case or not. There is some information that is needed.

It is hard to visualize what you described. You did a fairly good job of describing it, but its still hard to visualize it exactly. It would be interesting to know how fast you were driving and what the speed limit is. You also didn't say how far from your car the other driver was. That would make a difference. You have not stated exactly what you have been medically diagnosed with. I know your back and neck hurt, but you didn't say what the doctors said. Nor did you say if you went to the emergency room, nor how much your medical bills are, and how much medical treatment you have had. I can't tell if you have had two years worth of medical treatment of two days. These are very important things. A lawyer would also need to know what the prognosis is for the future. That is, will there be a surgery, physical therapy, wheel chair, etc.

I would suggest calling an attorney that practices this area of the law in your county and go meet with him/her or possibly a telephone consultation, and let the attorney ask you the necessary questions in order to advise you.
