Legal Question in Tax Law in South Carolina

I have a 5 year old child and i just got married to his father back in julyof this year . Now he doesnot have his dads last name yet he ahs my maiden name. How can his dad claim him even though he doesn't have his last name.i have another child that is my husbands step son by law . how can he claim him on his txesas well as ours

It doesn't matter what your children's last name is. The important thing is that you and your husband have custody of the children and pay for more than 1/2 of the support of the children.
