Legal Question in Traffic Law in South Carolina

I was charged for a 2nd offense D.U.S. 30 days after I went to the highway dept. and took the test,paid reinstatement fees,and completed A.D.S.P. course.They had put me back under suspension from a 9 year old ticket that they forgot to file and put and notify me of! They have now,after going trough a license check,charged me 2nd offense DUS and have suspended me till 1 03 2011!! Can you help me?

I'm very sorry for your troubles. I can only imagine what a terrible pain it must be to have to deal with DMV with this. Half the time they act like they do not have a clue what they are doing.

I do not understand enough about your case in order to be able to tell you what can be done. But I will tell you that there might be something.

If you went to DMV, and did every single thing that they told you that you needed to do in order to become a licensed driver again, then it certainly isn't fair for them to turn around AFTER and say that you are not in compliance. They have a responsibility to maintain proper records.

I have been able to help a lot of people out with DUS charges based on not the same set of facts, but very similar. I would need to know some things on your case, such as what the first ticket was for, fine and reinstatement information, and most importantly, I would need to verify the existance of a Notice of Suspension, which would be the solicitor's responsibility to provide to me if I represented you.

Its a horrible process to go through and I feel for you. But it sounds like it can be fixed. My office is in the Myrtle Beach area here in Horry County, but I can practice any where in the state. You are welcome to call.
