Legal Question in Traffic Law in South Carolina

In September 2009 I received a speeding ticket in Bennettsville, SC for speeding 60/45. My court date was rescheduled and I received a notice in the mail to that effect, however the notice I received which is a typed copy of the Uniform Traffic Ticket has my speed listed as 60/40.

I called to see if the ticket could be reduced & was instructed that I may call the City of Bennettsville 2 days prior to my court date.

The typed copy I received has options listed to the side which include

A: Plea Bargain Reduced to ______ Points

B: Speed Reduced ___________

I am concerned because the speed documentation on the ticket I received does not match the notice I received in the mail. What are my options?

You really need to call the court or an attorney. Here is how speeding tickets work in SC. We have 2 point, 4 point and 6 point tickets. Up to 10 is a 2 point, from 10 to 25 over is a 4 point and in 25 and over is a 6 point. The funny thing about your ticket, is that both 60/45 and 60/40 are both a 4 point violation since they are both between 10 and 25 over. You didn't mention what state you are licensed in. That is where you have to be careful. Some states look at just the points from another state and some look at how the ticket was writen. I have seen other states want to see the ticket that is being reduced say "9 mph over" and I've seen where they want it to say "less than 10 over." Also, if you are a NC driver there is a suspension if it gets transfered back as a 4 point or more.

So, call the court or an attorney.
