Legal Question in Wills and Trusts in South Carolina

dead beat dad statute of limitations

Biological father and mother divorced in early 70's. Father never paid child support. He was abusive/alcoholic. Kidnapped children (held mother at gunpoint - early 70's). No child support or contact with kids for 32 years.

Recently biological father contacted children (male 40 years old and female 32 years old). He has a new family and claims he tried to pay child support but couldn't find children (who remained in location from which he kidnapped them).

Can he be sued now for past child support? What are my rights as an heir if he dies? I live in Georgia, my brother lives in South Carolina and biological father now resides in Arizona with a new family including a wife, two sons and a grandson.

Re: dead beat dad statute of limitations

There is a satute of limitations on child support litigation. I believe your cause of action is now barred because you, or your mother, sat on your rights for too long.
