Legal Question in Family Law in South Dakota

How to change the last name of a child.

How do I change the last name of a child who has the name of her biological father to the mother's new married name if the mother was never married to the child's biological father? The mother has full custody and the biological father has reasonable visitation and does pay child support.

Re: How to change the last name of a child.

You need to contact the probate court in the county where the child is living to file for a name change. The father must be notified, and will have an opportunity to object.

You must go the local Probate Court and file an application to change the child's name. At that point the father has to be notified and will be given an opportunity to object.

Good Luck!!!!!!
