Legal Question in Family Law in South Dakota

Visitation with my son

I have full custody of my 2 year old son. The father has visitation rights of 8 hours on Sat and 8 hours on Sun e/o/wkend. However he has not seen his son since Oct 15, 2006. I want to file for a modification asking for his visitation to be reduced and in at least a public location so I can be there, because he is a stranger to my son.I am willing to work back up to the 8 hours unsupervised IF & WHEN my son can handle it. Can I do this, what should I ask for, and do I actually have a good chance at getting this?

Re: Visitation with my son

You ask for a modification, you file have to show that what you want is in the best interest of the child. I do not think what your asking for is unreasonable. I think you should get it.

To increase your chance for success, hire a good lawyer who concentrates

in custody and visitation issues.

Good Luck.
