US citizen on supervised release wants to file a petition for fiancee

Hi, I am an Austrian citizen and I would like to marry my fiance in the States and live there with him. He is a US citizen, living in South Dakota, was imprisoned, got released last year and is now on supervised release. Can you please tell me if he is eligible to file the petition for the Fiance visa on my behalf? Would any specific things be requested of us? He does have a well-paid, permanent job and is keeping to all requirements asked of him.
