Legal Question in Banking Law in Tennessee

Bad Check Received

I received a personial check as payment of my part of a prize fund won by a group of 5 people. The money was won in early June and the other people have been paid. I finally received a check for my part 4 months after the prize was won. When I checked with the bank which the check was written on, the funds to cover the check are not in the account. To make this a little more of a problem, I live in Arkansas, the check is on a Tennessee bank, and the person who wrote the check lives in Mississippi.

1) What recourse do I have to collect these funds?

2) Is there any place I need to report this person for writting bad checks?

You have recourse against the person who was supposed to pay you. You can file a Complaint aginst them to try to collect the money.

If you know this person and you think it might help, you can try to talk to them to get them to pay up without any legal action.

On your second question, you can report the bad check to his bank would be a good start. You also can report him to the police. But it may be easier to collect from this person without filing criminal charges first. You may want to save that as a later resort.

The first thing I would do is send this person a nice, but firm, letter explaining your position. You, or your attorney, may want to do that right away.
