Legal Question in Banking Law in Tennessee

Who is liable for theft from soldiers?

While I was deployed to Iraq, my husband withdrew funds from my bank account using a special power of attorney that was in no way related to my bank account. The bank is claiming no responsibility and has refused to replace the funds. I am now divorced and attempting to determine who is responsible and if there is a statute of limitation that exist on the matter. Could you please give me some guidance. This is happening to soldiers ever where while they are deployed protecting their country and our daily freedoms. Soldiers spend a year away from their families and some return with nothing to show for it. The dates of my deployment were from Feb 2003 to Feb 2004. The withdrawals took place between March 2003 to June 2003. My divorce was finalized in June 2005. I found out about the withdrawal and contacted the bank to inform them that the withdrawals were not authorized in the end of May 2003. I had to revoke a power of attorney that was not legitimate because they told me that this was the only way to stop the withdrawals from my account. I was in Iraq and this was the only avenue that I had available to me.

Thanks in advance,

Have your divorce attorney handle it. Your should be on the hook for this, not the bank.
