Legal Question in Business Law in Tennessee

Lease-- business

Is a lease valid if a named lessee had no knowledge of the lease at time of execution and her signature is not on the lease. Spouse has power of attorney but this was not addressed or attached. Spouse printed name where my name should be. I know I am probably not responsible, but I wanted to know whther that would make the lease void if it was never signed by all parties.

Re: Lease-- business

The answer may not be as simple as you believe. In part, it will depend on the nature ofthe power of attorney which your spouse had. Before you breach the lease (if that is your intention), you should consult with an attorney to discuss your situation in more detail than can be discussed in this forum. You could be exposing yourself to thousands of dollars in liability and a modest consultation fee is usually money well spent if it can help you to avoid that situation.
