I am a small concrete contractor. I recently acid stain a customers basement. For unknown reasons the stain is chipping off. I have offered to completely redo the job. The customer is an attorney and has demanded a refund in full or he will sue. There is no contract. He refuses my offer because he says it will cost him money to have the baseboards taken up and put back down. He also says because sanding will be involved he will have to take out his ceiling tile. He says I will have to pay all atty fees plus cleanup and the original fee.

A lot will depend on what you said in order to get the work. He may make a claim under the Tennessee Consumer Protection Act, which carries attorney's fees. However, in the absence of that, you are looking at a claim for negligence which typically carries the measure of damages as the measure of damages the difference between what he had to pay to have the work repaired and what he paid you.
