"Bank error caused foreclosure on home"

My home was put into foreclosure due to a bank error. I admit that I was behind but not enough for foreclosure The bank lost one of my payments, which was clearly marked that they had received(cancelled check). I have tried talking to the people saying they should have not chaged my loan for attorneys fee for foreclosure and prior to receiving a copy of my cancelled ck to prove pymt had been made they were saying that attorneys fees would be given back to me. Now they are trying to say I owe these fees and will not return my calls to dicuss this with me. This has been going on for almost 2 months now. I need to see what I need to do to get my money back.

Re: foreclosure

You admit you were behind but not enough for a foreclosure.

There is no minimum amount for you to be in default to permit them to foreclose. One day or one dollar is enough. Except to the extent the fees are attributable only to their mistake, you owe them.
