Legal Question in Credit and Debt Law in Tennessee

stop payment on check

A ''shade tree'' mechanic rebuilt an engine for me about 3 months ago. I had it back about a week, and it went out again. After 3 weeks of pleading, they finally came and got it. The have had it nearly 2 months, and are saying it is not their fault that it went out. I know they are trying to get out of their obligation. If I write them a check to get my vehicle back, and then stop payment on the check, what legal ramifications could I face? Or, is there some other way you might suggest?

Re: stop payment on check

Unless your "shade tree" mechanic was just born yesterday, I doubt that he will take a check from you. If you do give him a check and stop payment on it, he could take you to court to seek his money. I would suggest you try to speak to a local attorney about your problem as there are a lot of other things you may want to consider, perhaps even filing a court action yourself. However, there is more information about your situation that would be needed to properly advise you.
