Legal Question in Criminal Law in Tennessee

My 15 yr was driving with his father & sister in a truck and another driver was tailgating them and followed them into our subdivision forcing them to pull over . The other driver got out as did my son and the adult tailgater proceeded hitting my 15yr old in the face. Meanwhile my husband came around the truck and took the man down and gave the man what he deserved then the man after getting in his car drove his car towards my children hitting my husband? What are the laws this man broke and what can we do?

First off I would highly recommend calling the police and/or district attorney in your area to report the crime. With respect to the assault on your son this guy could be facing a general assault charge which is a class A misdemeanor punishable by up to a year. He could also be facing a child abuse charge with similar penalties since your son is under 18 years old. With respect to your husband, here is where this guy could be in big trouble. This will be a slam dunk for the district attorney to prove this guy acted intentionally in hitting your husband with his car. This is an aggravated assault, which in this instance is a class "C" felony carrying with it a penalty of 3 to 15 years in prison. You likely also have a civil claim against him on behalf of both your son and husband for any injuries that arose from this guy's actions. I practice in both Tennessee and Florida in cases like this.
