Changing last name of a child

My son is incarcerated his wife divorced him and they have a son. The ex wife wants to change the son's last name or hyphenate it with her maiden name. My son refuses, she says she can legally make him sign paperwork to change name. What is the law?

Re: Changing last name of a child

Normally, you cannot change the name of a child without the father's permission unless the court sees that it is in the best interest of the child. I would suggest he not sign anything until he is able to speak with an attorney.
