Legal Question in Family Law in Tennessee

divorce with family business

In-laws are getting a divorce after 28 years. They have a family business that is a marital asset. They want the children and in-laws to take depositions. I was told by my mother-in-laws attorney to do a deposition on Monday and I feel that this is something that the divorce should be between my husbands parents and not there children and the in-laws. Do i have the right to say that I will not do a deposition?

While you can refuse to testify, the court can also put you in jail for that refusal. Parties in lawsuits are entitled to call witnesses to testify for them and to require those witnesses to appear and to testify truthfully. The depositions are part of the process. Put up with it. If you want, you can hire an attorney to raise objections to the deposition you can do so, but the prospects of succeeding are generally remote.
