Legal Question in Family Law in Tennessee

Divorce Without the Husband

I was married to a man from Denmark in Ohio in 1993. He was in Ohio for less than 30 days and went back to Denmark. I have not seen him since and do not know where he is. I have been living in Tennessee for 10 years now and I would like to get a divorce. Where should I start?

Re: Divorce Without the Husband

It is likely that you will be able to obtain just a divorce under the circumstances you describe. What I mean is that the state of Tennessee likely has no personal jurisdiction over your husband but could declare the marriage terminated based upon your residency here. You would not be likely in a Tennessee action to recover any property or other payments from your husband, but only the divorce. How long it will take and the expense involved will be largely determined by whether or not you can locate him to give him notice of the proceedings. If you have any questions, I'll be glad to discuss with you. Thanks, Holland McKinnie; [email protected]
