Overweight Child Abuse By Divorced Mother

My step daughter is seven and weighs 115lbs we have taken her to a nutritionalist and the pediatrion but her mother will not help at all she and her family continue to feed her very unhealthy and she eats all the time my husband and I have been dealing with this for three years now and are scared to death she is going to die or have major medical problems. We have joint custody and we watch everything she eats at our home when we send her back to her moms we have been able to get a couple of pounds off but when she returns to us she is anywhere from 2 to 5 pounds heavier how can we correct this problem or take her away from mom?

You can file a petition for full custody of your daughter. Her weight constitutes a change in material circumstances warranting review of her custody. I have drawn up these petitions in the past for $100, which you can then file on your own without a lawyer in the juvenile court.

Certainly to can file a petition to modify on your own, either with so or without Michael Guth, but if you do so, I hope the outcome of the case is not particularly important to you. If if IS important, get an attorney who knows what he is doing.

The advice from Guth is like asking a doctor what you should do about the severe chest pain you've been having lately and having him hand you a couple of very sharp knives and suggesting you start carving into your chest.
