Step Parent Adoption

My husband would like to adopt my 2 children from a previous relationship. We live in Tennessee and my ex. lives in Illinois. How do we start this process?

We would file a joint petition for step parent adoption. Your ex-husband would have to sign the petition or we would have to terminate his parental rights. There are several grounds for termination, such as failure to pay child support and failure to visit.

A step parent adoption is fairly routine if the father does not oppose. I doubt seriously you will be able to accomplish this without an adoption lawyer, but, if it is uncontested it should not be extremely expensive. If you anticipate the father opposing the adoption, you will need to speak to an attorney who is capable of handling contested adoptions. A contested adoption is quite complex and will only be allowed in extreme circumstances. Good luck to you and your children.
