Legal Question in Civil Litigation in Tennessee

illegal wages?

I have worked for my employer for a little over a year. In January they switched from a flat day rate to hourly pay. A coworker tells me it is because someone threatened to sue them because they were making us do mandatory overtime on the day rate without paying us for it while docking our pay if the job took less than 8 hours. He also says they can't pay us a day rate unless the job can be completed in that day, and each job would take at least 10 hours a day and around 3 days to complete. Many times we were pressured to work 12 or 14 hours. I have my timecards to prove my hours. Is there any truth to this? Do they owe me back pay for all that overtime?

You will need to address your questions with the U. S. Dept of Labor. It is very likely that docking your pay creates an issue that may make them liable for overtime.
