Late counter response

I have a civil suit against me. I

counter sued with my lawyer. The

Plantiff lawyers took 69 days to

respond to my suit. 39 Days over the

time allowed. I wanted to file for a

default judgment but my lawyer did

not want to cause he said it would be

a waste of time. He said the judge

would probably just ask the other

side when they were going to file and

then he would dismiss the default. Is

this true. If it is why do they have

the 30 days rule and not follow it.

That is one of the unfortunate truths about Tennessee courts. As a general rule, Tennessee courts are very forgiving about missing the deadline for filing an answer to a complaint or counter-complaint.
