Legal Question in Civil Litigation in Tennessee

Unpaid loan

I made a series of loans to a now ex-boyfriend last year. All were in the form of a check. For the last and largest I even got him to sign a loan agreement. He has not repaid or attempted to repay any of the loans. I have sent him a letter via certified mail reminding him of his debt. Can he get out of repaying me?

Re: Unpaid loan

In a word...no. Your ex-boyfriend will be obligated for the amount of the debt, provided that you can establish that these loans were just that and not gifts. For the purposes of the last loan, the written agreement should stand you in good stead. Copies of your cancelled checks may also help if you noted that the proceeds were loans and not gifts.
