You may file for your boyfriend to once you get married, but the process of how he can obtain a green card will depend on his specific background. If he did not enter with a visa, he will have to go back to his home country to get a green card through the consulate with a waiver of his unlawful presence. The only way around this is if he is 245i eligible. Someone is 245i eligible if an immigration petition or labor certification was filed on their behalf before April 30,2001. You should consult with an immigration attorney before proceeding with any applications for relief.
