Legal Question in Medical Malpractice in Tennessee

My father had surgery at a TN medical facility and was making an excellent recovery. About a week later, he was transferred to another facility( 4 hours away from home, so family was not able to be there as often as we wanted) for rehab. After 21 days, suddenly they contacted the family and stated they were discharging him to a nursing home?? He was there less than 3 days and had to be admitted to a hospital through their ER dept. It was then we found he had; bed sores, pneumonia, MRSA, was malnourished and had a severe infection a his surgical site. Unfortunately, by the time he arrived at the hospital, his condition was so bad, they were not able to save him and he died a week later. I requested my father's medical records from the hospital he was sent to for rehab and was shocked at what I found. According to their records, they knew my father had pneumonia, had the infections and was malnourished, but still they chose to discharge him to a nursing home. I need to know if this could/would be considered medical malpractice? I can not imagine that they should not be held libel.
