Legal Question in Personal Injury in Tennessee

Could this be defamation or libel?

My wife and I have been marrid for 15 yrs. and have 5 kids. We noticed that our oldest (19 yrs) is having his life and our posted on a public website for the world to view and comment. It posts lies about us and my kids. We tried to resolve the issue by contacting the father of the kid but did not work. He has posted many blogs about my kids and wife and has no intention on stopping.

What can I do?

If the person is telling lies about you or your family or invading your privacy, you can go to court and have a judge order him to stop. You might also be able to get money damages, but I doubt this kid can pay them.

Once you have the court order, if he continues to post these lies on the internet the judge could send him to jail.

Truth, like beauty, is often in the eye of the beholder. In theory you could sue the 19 year old for libel, which is written defamation, but you would have to prove that what he is written is an absolute lie, and not just wrong as you know it. You could potentially sue the Internet web hosting service, and they might drop his blog rather than fight with you in court. But this is probably not the first time the web hosting service has been sued, so they may have a defense that they provide a service and do not scrutinize the content for accuracy. The real tort feasor is the 19 year old. You could start your own blog to correct the inaccuracies of his message.
