Is a property owner liable for damage to my car when i paid to park on his lot?

Did the property owner park the car? Who caused the damage to your car? Did the property owner do anything to cause the damage? If you merely parked on an open lot and paid a fee for parking and the property owner did nothing to cause your damage, then he is not responsible.

While the questions attorney David Waldrop raised are relevant in determining whether the property owner will be liable, it is not quite that simple.

The issue is one of whether the property owner was negligence, and negligence will be decided on a case by case basis, depending on the unique facts of the case.

If the property owner knew of a problem creating a risk of danger and failed to take reasonable steps to prevent it, or to inform you of it, the property owner would have been negligent and liable.
