Legal Question in Personal Injury in Tennessee

My son was playing at a neighbors house and his son was injured. The neighbor allowed them to play cops and robbers (and was not supporvising) with real BB guns. I was not aware of this until they came to me with the problem. He wants me to pay all medical bills and my problem is why were they allowed at 13 and 11 to play with the guns to begin with. Who;s at fault?

It would be argument that the homeowner is at fault. The homeowner's insurance should cover the medical damages and otehr damages associated with this. However, I anticipate that the homeowners carrier will not be excited about paying anything and that you will have to fight with them to get anything at all. I have had a number of experiences with carriers like this and each time we have had to prove our willingness to fight before they would cover anything.
