Legal Question in Real Estate Law in Tennessee

We bought a home from a builder in an upscale executive neighborhood. Now that the economy has slowed the builder wants to change the PUD so they can build smaller homes right in the middle of our neighborhood. This will obviously affect the values, appearnance and traffic in what we were sold as an upscale nice neighborhood. Do we have any recourse or options to stop the builder from doing so?

They are not losing money, they currently have 6 new executive homes going in now but want to make even more money faster.

Contact the governmental body who has control over changes to the PUD (either city or county depending on where your property is located). Advise them of your objection. Ask questions about how a revision to the PUD would work and what can be done to prevent the revision. Also, contact the elected representative serving your area - if in the county in Tennessee, this person is a commissioner. If in a city, then likely this person is an alderman. Let him/her know of your concerns and ask for assistance.

I also recommend that you speak with an attorney who practices in this area - zoning and subdivision law - about your options. It may be worth investing in a consultation if the proposed PUD revision could have a negative effect on your property value.
