Legal Question in Wills and Trusts in Tennessee

My husband has pass, we have wills, leaving everything to each other. Everything we own is in both are names, so I have to probate?

If "everything you own" is in both names, unless there is a contrary declaration in the documents you would own the property as "tenants by entireties" which means that the survivor owns everything. Thus, there would be no reason to probate the estate.

Just be sure that what you believe to be true, i.e. that everything is titled in both names, is in fact true.
