Legal Question in Wills and Trusts in Tennessee

My Sister in Laws Husband died last week. Her brother in law (her husbands brother) says he had his brother sign a sole survivor agreement before my sister in laws marriage 3 years ago. Is that document binding and how should it have been filed?

The only way to devise property in Tennessee is through a will. If this document (sole survivor agreement whatever that is) is designed to deprive his widow of rights under probate law it may well be unenforceable as against public policy. best bet, open an estate and drive out the agreement so an attorney can properly review it.
