Legal Question in Wills and Trusts in Tennessee

appropriate time to read will after death

My dad passed away 2 weeks ago & my brother is on on leave from Iraq. We want my dads Will read before he returns to Iraq. My step mother isn't too happy. How long after death is an appropriate time to read a will? We don't want to seem too pushy. Its locked up in a safe & she's got the key!

Re: appropriate time to read will after death

There is no statute forcing the reading of the Will. However, if a person refuses to probate an estate, any interested party could request the court appoint them as executor as a means to encourage the person named in the Will to come forward and to produce the Will and begin the process.

I understand how delicate this is and would only do this as a last resort. But if an unreasonable delay is expected, I would use this means. I can help 423 266-4855

"Reading a Will" really means opening an estate

with the Court and probating the Will. There is generally no statute of limitations on probate.
