Legal Question in Wills and Trusts in Tennessee

My wife and I moved from Michigan to Tennessee 12 years ago. Prior to leaving MI. we had new Wills drawn up. Recently, we had a friend suggest that our Wills from MI. may not be valid in TN. Is this correct and we need to get new Wills made in TN? Thank you.

If your wills were drafted and executed properly in Michigan, then it is likely that the documents will be considered legally valid in Tennessee. However, the laws of wills and probate are unique in each state. When you move to a new state, you should always have your will documents reviewed to confirm that your needs and goals will be met with the existing documents, because the documents were drafted to comply with the laws of your former state of residence, and not your new state of residence.

There are specific aspects of Tennessee law that should be addressed in a properly-drafted will document. Without reference to these laws, your wills likely will not be as effective as they could be otherwise. It's unlikely that a will drafted in Michigan adequately addresses Tennessee law, which is why you should consult with a Tennessee attorney who specializes in wills and estate.

I hope this information is helpful.

Best regards,

Caitlin
