Legal Question in Workers Comp in Tennessee

If a person has a case that involves injury at work but the establishment has no workmans comp. insurance and they state they are going to file for bankruptcy can they still be sued in a court of law before or after the bankruptcy.

You can sue but if the employer files bankruputcy, you may have to postpone your lawsuit until the bankruptcy court decides how your claim should be handled.
