Heart Attack & Workers' Comp

I had a heart attack on the 14th of March while climbing a utility pole for recertification. I fell approximately 15 - 20 feet, went into cardiac arrest. I now have a PaceMaker/Defibulator installed for life. Workers' Comp, after 3 months have denied my claim, due to a pre-existing heart attack in 1991. I have since lost my job because I am restricted from driving, which is 90% of my job. Is a heart attack on the job not covered by WC? Does a pre-existing condition of ten years let them off the hook?

There is a fairly well established line of cases in Tennessee regarding workers comp claims for heart related injuries. Your case will depend upon the medical proof and the facts related to the 3/14 incident. Your pre-existing heart condition will not in and of itself affect your claim, although it certainly might be a factor. Your claim can also be affected by the type of employment you were in. There are special rules with regard to heart cases for certain types of public employment (police, fire, EMT).
