Legal Question in Workers Comp in Tennessee

mrsa infection

A hospital worker has claimed that her sinus surgery is related to a hospital acquired infection due to being exposed to the infectious organism (mrsa)on the job--not as a patient. This organism exists endemically (small % of population) and you can have it and not be ill (colonized. Some facts: She scanned 2 patients who were positive for this organism 1 month before her own medical loa and an immediate co-worker is colonized but not ill. Should we declare this as work related?

Generally, any injury that is attributable to the workplace is covered by worker's compensation. An infection would qualify as such an injury. The injured person must also have some adverse consequences from the disease in order to obtain a recovery over and above recovery of their medical expenses.....
