Spouse forgery of credit card applications

I'm currently going through a divorce and have discovered several credit cards and loans that are in my name. The problem being is that I did not aquire these debts, my signature was forged on the applications by my spouse. Is this criminal? And if so, what can I do about it?

Re: Spouse forgery of credit card applications

I am in San Antonio, not sure where you are, but you need a local lawyer, or at least one within a hundred mile radius. It depends on who is on the list as authorized signator. If she is on it, then she can use the card and she is not forging your name but obstensibly using it by permission. If you want to stop this, write a letter to the credit card company, explaining that no one is aollowed to sign your name but you. Then she would have problem, if she signed your name. The loan documents present an interesting situation wherein the lending institutions have co-responsibility with your wife by accepting your wifes representation that she could sign your name, if that is what occurred, if it was by mail or fax, then the bank has a duty to verify the signatures as genuine. Call me at 210.224.5811 if I can answer any questions or provide any assistance; no charge and no obligation ... I deal with these situations frequently in my divorce cases ...
