I have a court appointment for a bankruptcy case where one of my creditors is filing fraud. I live out of state and can not afford the travel expense of making the court appearance nor can I afford an attorney. the appearance is within three weeks and I have made several attempts throughout having my appointment date to obtain funds for both the travel and propert representation with no avail. Please advise if I am able to prove my hardship to the court and have a conference call hearing or something similiar . Please advise of my options if there is any?
Bankruptcy is a very formalized process. If you are not represented by counsel, you are in a major problem. However, you don't say whether the other party has filed an "Adversary" action against you alleging fraud. He will have to prove that. YOu really should try to find the funds to hire an attorney to at least review this to determine how to proceed.
