Legal Question in Bankruptcy in Texas

I filed bankrputcy in 2005, it has been discharged for 5 years now. Out of the blue, after not hearing from them for 5 years, I get a call from a collection agency about a debt that was filed on the bankruptcy, and they want almost 4000 dollars. What can I do?

If you simply provide them the case number, court it was filed in, and the discharge date then that should take care of it. A creditor can be sued for trying to collect debts that were already discharged. Since they probably don't want to be sued, they probably will close the file once you've informed them about the prior bankruptcy discharge.

The exception might be where this particular debt was not dischargeable. Whether it was not dischargeable depends on what type of debt, when it was incurred, etc.
