I have a boat repair shop and I had a man bring me a boat for repair over 2 years ago and he left it and did not come back to get it or have it repaired after I spent several hours tearing it down and giving him what it would cost to repair. Now he wants his boat back but the motor was torn apart so after a year I disposed of it. What can I do to make sure he does not try to sue me
Do you have a sign clearly posted in your shop regarding how long people have to pick up their "stuff"?
If not, get one & put it up immediately.
Be sure it's big and bold & clearly posted.
Also, put the same wording on all your receipts & repair orders.
Here is what I learned in law school...
Anyone can sue you at any time for any reason.
It does not mean they will win.
I hope this helps.
You can counter-sue for "storing" his stuff.
(I don't know if a judge will "appreciate" this argument).
If you don't have an attorney that you consult with on a regular basis, I'd find one and keep his name and phone number on your phone for these sorts of issues.
Check out this website and www.avvo.com for a good consumer and/or small business attorney that owns a boat!
