What is the legal difference and significance between the term ''Including'' and ''Shall include'' when used in the language of the law?

It is my opinion that virtually all lawyers will be reluctant to reply to your question without seeing the sentence about which you are inquiring. Some will say that the question is tantamount to "What is the law governing contracts?" -- To which most would ask "Can you be more specific?"

The kicker actually is the "shall" which, in legal-speak, means "must". As to the rest, it all depends upon the context within which it's used. The law usually relies on the plain meaning of words.
