being defrauded by US Supplier

We are a Plastic Film Agent for our Hong Kong and China Clients. Recently we were defrauded by The Plastic Film Supplier, Global Plastics Company.

First Case: Our China Client has been cheated. As the Goods arrived at Xiamen, our client paid the amount according to Bill of Lading. Unfortunately they checked annd found the Goods were totally different from the B/L. All B/L and Documents were counterfeit. This supplier (Global Plastics) colluded the Forwarder (Crescent Line Inc.) to issued fake Bill of Lading.

Second Case: We also ordered some films from this supplier, and paid in advance for deposit. Unitl now we have not received any things and Goods ,and then phoned, faxed and emailed to this supplier, but no response.

Note: Although this Supplier address is located in Louisiana, they issued all documents from Texas, and even their Bank Account and Forwarder.

Please provide us some legal advice.

If you have been dealing with a Jeffrey McVaney, he is an individual in Harris County, Texas, doing business as Global Plastics Company.

Whether a lawsuit would be profitable or not would have to be determined.

How much does he owe you?

The information you provide is not sufficient to enable me to completly analyze your problem. The first step would be to demand that your supplier correct the problem. I assume you have done that. The next step would be to investigate the supplier and freight fowarder to determine if they have 1) any money and 2) a history of bad performance. If theis matter cannot be settled by negotiation then it would be necessary to bring a lawsuit against all parties who have caused damage to you. From what you have written I cannot determine where the company or freight forwarder is located so I cannot advise you as to where the lawsuit should be brought.
