Legal Question in Business Law in Texas

I am trying to fight a cell phone company that signed me up for a 2 year data plan of $30 per month without my knowledge. They are telling me that they cannot do anything about it because it is a legally binding contract since their associates are trained to inform all customers about the add on when certain phones are purchased. The associate that sold me the phone never mentioned anything about it. Legally what is right and what can I do about it?

If they're trying to make you pay for something you didn't agree to, then don't pay them.

I would send them a letter (a PAPER letter - keep a copy - no emails or texts - send it certified) telling exactly what happened. Include dates and names of people you talked to. Tell them that you are canceling the contract.
