Legal Question in Business Law in Texas

My partner and I are not getting along so I want to sell the business . Found a buyer and took $30k deposit but only I sign the accept of the deposit. Now my partner change her mind not selling the business. In the contract if we change our mind we have to refund the deposit and addition $30k. My partner claim that she didn't sign so it does not count. Can she do that? Cuz the buyer is suing us

JEEZ, you really needed a Lawyer from the start. That question has many potential issues that can not be determined that answering it would be virtually impossible without reviewing the partnership agreement, sales contract, lawsuit, etc. If you need free 30 minute consultation on that, just contact me. MEANWHILE, be sure you file an Answer denying the claims in the lawsuit. IF it has other issues or you need to assert certain legal defenses, they must be filed with your Answer (deadline in the Citation you received). PLEASE GET A LAWYER. You all may want to consider Mediation as well.
