Deceitful Builder

Shortly after moving into our newly built home, we were informed that our yard wasn't graded properly; water ponds around the home, the foundation was poured out of plan and load bearing walls were hanging over the foundation by 1 1/2 inches in several locations. In april 03, after complaning to the builder; the builder added cement,to the ground level, too the foundation's edge/face to fill-in the void and hide the defects. The cement added no support to the walls hanging over the foundation. The builder stated, in writing, the repairs were recommended by an engineer. Two week later after I had requested a copy of the engineer's report,The builder sent

their engineer to the property. He in-turn wrote a bogus report and stated the repairs and procedures were typical and that the foundation should perform as orginally design.As of this day, water still ponds around the home, the foundation is cracking and deteriorating; metal inside of foundation is exposed. There are not support for the walls hanging over the foundation; walls inside of home are starting to crack and the cement that was added to the foundation to hide the defects makes it easier for wood destroying insect to enter the structure undetected. Please advise.
