Legal Question in Construction Law in Texas

Lien Law State of Texas (Paid When Get Paid?)

Customer pays for construction service. General Contractor interacts with architect for AIA documentation and payment. General Contractor contracts subcontractor. Subcontractor elects subdivision of contract. General Contractor lacks payment to subcontractor. Sub of sub files lien. Pay when paid? General Contractor has not paid, therefore is responsibility of subcontractor to pay their subcontractor if not paid?

Re: Lien Law State of Texas (Paid When Get Paid?)

Unless a contract says otherwise, someone who provides goods or services should be paid by their terms when the goods or services are provided. The "I didn't get paid so you don't get paid" doesn't wash unless that's written into the contract.

Suit to enforce the lien must be started within two years from the date the lien was filed.
