Legal Question in Consumer Law in Texas

automobile rental co

my son rented a car he is 23 yrs he scratch the car and their trying to charge him 1150.00, they refuse to let us have the car buff and touch-up their is a chip about the size of a pea and their stating the whole car has to be painted. also they say no one else can repair the damage only them and if we dont agree to it they will charge our insurance company. it sounds like black mail to us. what is our rights, should we pay them under the table or let it go on our insurance and then sue them. could you please help, i have no problem in retaining a attorney if necessary. thank you deb durand

If the rental car company wants to make a claim against your insurance co., tell your agent what's going on and let the adjusters handle it. They know very well how to deny claims.

Let your insurance company know what's going on, and let the rental company file a claim with them.

You have no basis to sue them, since they've not injured you. Your son is at fault, but that doesn't justify their demand that the entire car has to be repainted.
