Used Car Title not received from previous owner

I bought a used car in March 2002 and cannot get the used car dealer to give me the title. The car was purchased for $2,100.00 cash, paid in full. The only explaination is the previous owner cannot find the title.

Now the car needs repairs and I don't want to put the money into it, especially if I cannot get the title from the dealer.

Can I return the car (due to not having legal title) and ask them for a percentage of the 2,100.00 in return, or even trade for another vehicle on their lot? What are my legal rights here in Texas? And, would I need to disclose there are problems with the car now that I've driven it since March?

I would be very concerned if I bought a vehicle in March and the dealer has not conveyed title to you yet. The dealer may not have the title or have sold you a vehicle they did not have good title to. Contact the Texas Department of Transportation and ask to do a title search on the VIN number of your vehicle. You may have a cause of action against the dealer.
