Legal Question in Consumer Law in Texas

Defective Refrigerator

In May 04'I purchased a brand new refrigerator from a retail store. Two months later it broke down. The store sent their technician out to fix it. The refrigerator worked for awhile and broke down again. To make a long story short, the refrigerator has been repaired five times in less than a year. The refrigerator has even been removed from our home for two weeks to make repairs. However, when we got it back it broke down again.

I utilized the store's finance company to purchased the refrigerator. I would like a new refrigerator but the store is telling me they will fix it. It's obvivous that the refrigerator is defective. I have continue to make my monthly payments on time because I don't want to ruin my credit. If the store refuse to give me another refrigerator what other avenues can I take to resolve this matter?

Re: Defective Refrigerator

Speak with a lawyer in your area about filing an action under the Deceptive Trade Practices/Consumer Protection Act. It's too intricate to set out here, but it's evident that the store sold you a defective refrigerator.
